3. Personal data means all information relating to an identified or identifiable natural person; an identifiable natural person is one who can be directly or indirectly identified, particularly by reference to an identifier such as name, identification number, location data, online identifier, or by one or more factors specific to the physical, physiological, genetic, psychological, economic, cultural, or social identity of that natural person.

4. The Controller has not appointed a data protection officer.

II. Sources and Categories of Processed Personal Data

1. The Controller processes personal data provided by you or obtained by the Controller through fulfilling your order.

2. The Controller processes your identification and contact data and data necessary for contract fulfillment.

III. Legal Basis and Purpose of Processing Personal Data

1. The legal basis for processing personal data is:

• performance of a contract between you and the Controller pursuant to § 13(1)(b) of the Act,

• legitimate interest of the Controller in providing direct marketing (especially sending commercial communications and newsletters) pursuant to § 13(1)(f) of the Act,

• your consent to processing for direct marketing purposes (especially sending commercial communications and newsletters) pursuant to § 13(1)(a) of the Act if no goods or services have been ordered.

2. The purpose of processing personal data is:

• processing your order and exercising rights and obligations arising from the contractual relationship between you and the Controller; personal data required during ordering (name, address, contact) are essential for successful order processing. Providing personal data is necessary to conclude and fulfill the contract; without it, the contract cannot be concluded or fulfilled by the Controller,

• sending commercial communications and performing other marketing activities.

3. The Controller does not engage in automated individual decision-making as defined by § 28 of the Act. You have provided explicit consent to such processing.

IV. Retention Period for Personal Data

1. The Controller retains personal data:

• for the period necessary to exercise rights and obligations arising from the contractual relationship between you and the Controller and to enforce claims arising from these contractual relationships (for 15 years after termination of the contractual relationship),

• until consent for processing personal data for marketing purposes is withdrawn, up to a maximum of 5 years if processed based on consent.

2. Upon expiry of the retention period, the Controller deletes personal data.

V. Recipients of Personal Data

1. The recipients of personal data are persons:

• participating in the delivery of goods/services/payment realization based on a contract,

• ensuring e-shop operation services and other services related to e-shop operation,

• providing marketing services.

2. The Controller does not transfer personal data to third countries (outside the EU) or international organizations.

VI. Your Rights

1. Under the conditions set forth in the Act, you have:

• the right of access to your personal data pursuant to § 21 of the Act,

• the right to rectify personal data pursuant to § 22 of the Act, or to restrict processing pursuant to § 24 of the Act,

• the right to erase personal data pursuant to § 23 of the Act,

• the right to object to processing pursuant to § 27 of the Act,

• the right to data portability pursuant to § 26 of the Act,

• the right to withdraw consent to processing in writing or electronically to the address or email of the Controller provided in Article III of these terms.

2. You also have the right to file a complaint with the Office for Personal Data Protection if you believe your personal data protection rights have been violated.

VII. Conditions for Securing Personal Data

1. The Controller declares having implemented all appropriate technical and organizational measures to secure personal data.

2. The Controller has taken technical measures to secure data storage and personal data repositories.

3. The Controller declares that only authorized persons have access to personal data.

VIII. Final Provisions

1. By submitting an order via the online order form, you confirm that you have been acquainted with the personal data protection terms and accept them fully.

2. You consent to these terms by checking the consent box in the online form. By checking the consent box, you confirm having read and fully accepting the personal data protection terms.

3. The Controller is entitled to change these terms. A new version will be published on its website and also sent to your provided email address.

These terms take effect on October 1, 2024.
